Question: My 21-year-old son was arrested on a possession charge – under 20 grams of marijuana. He hasn’t been in trouble in over a year. He was on probation for possession of a gun and had a few minor traffic charges. What can I expect the court to do?
Answer: First off, he needs to grow up. Since you said he WAS on probation, I have to assume he is not on any kind of supervision at all. When I get a question like this, I wonder what it will take for your son to, “get it”. It’s time for your son to grow up. Minor charges such as traffic infractions are a sign that your son still needs to grow up. He thinks he is invincible and that is scary. The gun charge is a whole different story and worries me the most.
As far as what you can expect, possession of under 20 grams of marijuana is a misdemeanor, at least in Florida it is. A misdemeanor carries less than a year in jail. What most Judges do is try and find a way to help a young person to wake-up, open their eyes and make them realize they are heading in the wrong direction and it could get a lot worse.
